Kjota offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

If you are under the age of majority in your jurisdiction, you may only use this site with the consent and supervision of a parent or legal guardian. Purchases made by minors must be authorized by their parent or legal guardian. We reserve the right to cancel orders if we suspect unauthorized use of payment methods.

You agree not to use our products or services for any illegal or unauthorized purposes and to comply with all applicable laws and regulations in your jurisdiction, including but not limited to copyright and intellectual property laws.

You must never upload, transmit, or distribute any worms, viruses, malware, or any code intended to cause harm or disrupt the functionality of our website or services.

Any breach or violation of these Terms will result in the immediate termination of your access to our services without prior notice. We reserve the right to pursue legal action.

We reserve the right to refuse Service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

Prices for our products are subject to change without notice.

SECTION 5 - PRODUCTS OR SERVICES

Our products are created using print-on-demand technology, meaning each item is custom-printed after your order is placed. Due to this customized nature:

1. Orders cannot be canceled once production has begun.
2. Returns are limited to quality issues or significant deviations from product descriptions.
3. Personalized or custom-designed items cannot be returned unless there is a quality defect in the printing or base product.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy: https://KjotaOfficial.com/policies/refund-policy

We make every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.  We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.

 

SECTION 6 - ORDER PROCESSING AND FULFILLMENT

As a print-on-demand business:

1. Production begins only after your order and payment are confirmed.
2. Estimated production times are provided but not guaranteed due to the custom nature of each order.
3. Production times are separate from shipping times, which begin after production is complete.
4. Rush orders may be available for an additional fee but are subject to capacity limitations.

 

SECTION 7 - PRODUCTION SPECIFICATIONS AND QUALITY

Our print-on-demand products are created individually upon order. Due to the nature of this process:

1. Minor variations in color, size, and positioning may occur between the digital mockup and final printed product.
2. Each item is manufactured individually, which may result in slight variations between identical orders placed at different times.
3. We strive to maintain high quality standards, but due to differences in screen displays, the final printed products may differ slightly from what appears on your device.

 

SECTION 8 - PRINT QUALITY AND COLOR DISCLAIMER

Colors and appearance of final printed products may vary from what is displayed on digital devices due to:

1. Differences in screen calibration and display settings across devices.
2. The physical properties of the base materials being printed on.
3. Standard variations in the printing process and ink absorption.

We make every effort to ensure consistency, but some variation is inherent in the print-on-demand process. Digital mockups are representations but may not perfectly match the final product. Color-critical orders should request a physical proof (additional charges may apply).

 

SECTION 9 – CANCELLATION POLICY

Due to the custom nature of our print-on-demand products, we have specific guidelines on cancellations.

Customers may cancel their order within 1-2 hours of placing it, provided the order is still being processed and the production has not yet started.  This processing duration varies by the product and the print provider.  Therefore, we cannot predict it for your specific order or offer guidelines on how long you may wait before cancelling your order.  If it has not yet begun production, cancellations during this period will be processed without penalty.

Once an order enters production, cancellations are no longer permitted due to the custom nature of our products.

If you believe there is an exceptional reason to request a cancellation, please contact our support team immediately. https://KjotaOfficial.com/pages/contact  While we cannot guarantee cancellation, we will review your request on a case-by-case basis.

If a cancellation request is approved after production begins, any refund issued will be partial and will exclude production costs already incurred.

 

SECTION 10 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

SECTION 11 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

In addition to comments and feedback, when you submit designs or content for printing:

1. You retain ownership of your original designs and intellectual property.
2. You grant us a limited license to reproduce your designs solely for fulfilling your order.
3. We may feature your order (without personal information) in our promotional materials unless you explicitly opt out.
4. We reserve the right to reject any design that violates our content policies or may infringe on third-party rights.
5. You are solely responsible for ensuring that your submitted designs do not infringe on any third-party intellectual property rights.

 

SECTION 14 - INTELLECTUAL PROPERTY RIGHTS

By submitting designs or content for printing on our products, you confirm that:

1. You own or have legal rights to use all intellectual property contained in your submitted designs.
2. You grant us a limited license to reproduce your designs solely for the purpose of fulfilling your order.
3. You will indemnify and hold us harmless from any claims resulting from intellectual property infringement related to your submitted designs.

We reserve the right to refuse printing any content that we believe violates copyright, trademark, or other intellectual property laws, or that contains objectionable content as determined at our sole discretion.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order.

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free.

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. In no case shall Kjota, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
